1. who we are

miure is a brand of Professionails NV.

In these terms, “we”, “us”, “our” and “miure” mean Professionails NV. “You” means the person placing an order or using the website.

2. what these terms apply to

2.1 These terms apply to every order placed through miure.com and to every contract that results from such an order.
2.2 By placing an order you confirm that you have read and accepted these terms. Your own terms do not apply, unless we have accepted them in writing in advance.
2.3 miure.com sells to consumers. A consumer is a natural person acting for purposes outside their trade, business or profession. If you are buying for business purposes, the consumer rights in articles 8, 9 and 10 do not apply to you, and we ask you to contact us at hello@miure.com before ordering.
2.4 You must be at least 18 years old to place an order. If you are under 18, you may only order with the involvement and consent of a parent or guardian.
2.5 We may change these terms. The version that applies to your order is the version published on the website at the moment you place that order. We keep previous versions available on request.

3. products and product information

3.1 We describe our products as accurately as we can. Photographs, videos and swatches are illustrative. Colours can appear differently on different screens, and the finished result on your nails may differ from the images shown.
3.2 Our products are cosmetics and consumer devices for personal use. Follow the instructions and warnings supplied with the product and on the packaging.
3.3 Ingredient lists, warnings and usage instructions for each product are shown on the relevant product page and on the product packaging. If you have any doubt about whether a product is suitable for you, do not use it and contact us.

4. prices

4.1 All prices are shown in euro and include VAT and all other unavoidable taxes. The VAT rate applied is the standard rate of the country to which your order is delivered. The rate applicable to your order is shown at checkout before you confirm it.
4.2 Delivery costs, and any other costs, are not included in the product price. They are shown separately and always before you confirm your order.
4.3 The total amount you will pay, including all costs, is shown to you before you place the order.
4.4 If a price on the website is obviously incorrect, for example a clear typing error, we are not obliged to deliver at that price. We will contact you, and you may cancel the order at no cost.
4.5 Any promotional price is compared against the lowest price we applied for that product in the 30 days before the promotion started, except where the law provides otherwise.

5. placing an order

5.1 You place an order by adding products to your basket and completing the checkout process. Before final confirmation you can review and correct your order and your details.
5.2 The contract between us comes into effect only when we send you an order confirmation by email. Confirmation of your payment is not in itself acceptance of your order.
5.3 We process orders immediately. Once an order has entered our picking process, which normally happens within minutes of the order being placed, it can no longer be changed or cancelled. This does not affect your right to withdraw under article 8 once you have received the products.
5.4 We may refuse or cancel an order, including where a product is unavailable, where we suspect fraud or abuse, where the order appears to be for professional resale, or where there is an obvious error in the price or the product information. If we do, we will tell you and refund any payment in full without delay.
5.5 If a product turns out to be unavailable after your order, we will tell you as soon as possible and refund the amount you paid for that product, without delay and in any event within 14 days.

6. payment

6.1 Orders are payable in advance. We ship after we receive payment.
6.2 We accept the payment methods shown at checkout. These are Shopify Payments, PayPal, and through Mollie: iDEAL, Bancontact, KBC/CBC, Belfius, Klarna Pay Later, and Visa, Mastercard, American Express, Cartes Bancaires and PostePay cards.
6.3 Payments are processed by our payment providers. We do not store your full card details.
6.4 Where you pay through a provider such as Klarna or PayPal, that provider’s terms apply in addition to these terms for the payment itself.
6.5 The products remain our property until we have received payment in full.
6.6 We do not sell gift cards.
6.7 We do not issue an invoice as a matter of course for orders placed by consumers. You receive an order confirmation and a record of your payment, which is sufficient for consumer purchases.
6.8 If you require a VAT invoice, request it at hello@miure.com. Invoices are prepared manually, and we charge an administration fee of €15 including VAT for doing so. The fee is stated on the invoice itself and is confirmed to you before the invoice is prepared.

7. delivery

7.1 We deliver to Belgium, the Netherlands, Luxembourg, France, Ireland, Germany, Austria, Spain, Italy, Portugal, Denmark and Finland.
7.2 Delivery costs and estimated delivery times per country are shown on our shipping page and again at checkout. Delivery is free on orders of €65 or more.
7.3 Orders placed before 3pm on a working day are dispatched the same working day. Orders placed after 3pm, or on a weekend or Belgian public holiday, are dispatched on the next working day.
7.4 Delivery times shown on the website are estimates. In any event we will deliver within 30 days of the day the contract came into effect, unless we agree a different period with you.
7.5 If we do not deliver within that period, you may ask us to deliver within an additional reasonable period. If we still do not deliver, you may cancel the contract and we will refund everything you paid without delay.
7.6 We deliver to the address you give us. You are responsible for the accuracy of that address.
7.7 The risk of loss or damage passes to you when you, or someone you have designated other than the carrier, takes physical possession of the products.
7.8 Please check your order on arrival. If something is damaged, missing or incorrect, contact us at hello@miure.com as soon as you reasonably can, with your order number and a photograph where relevant, so that we can resolve it.

8. your right to withdraw

8.1 You have the right to withdraw from your purchase within 14 days without giving any reason.
8.2 The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier that you have designated, takes physical possession of the products. Where your order is delivered in several parts, the period runs from the day you receive the last part.
8.3 To exercise this right, you must inform us of your decision to withdraw by a clear statement before the period expires. You can do this by:

  • starting a return in our return portal, using your postcode and order number
  • emailing us at hello@miure.com
  • using the model withdrawal form in the annex to these terms, which is also available on our returns page
  • You do not have to use the form, and you do not need our approval to withdraw. Any clear statement is enough.

8.4 You must send the products back to us without delay, and in any event within 14 days of telling us that you are withdrawing. The deadline is met if you send the products back before that period expires.
8.5 The direct cost of returning the products is yours, except in the cases set out in article 8.6. Our return portal generates a return label and the cost of that label is €4.95, paid by you at the moment you create the label.
8.6 You do not pay the return cost where the product is damaged, faulty, or is not the product you ordered. In those cases, do not start a return in the portal. Email us at hello@miure.com and we will arrange the return at our cost.
8.7 You may handle and inspect the products in the way you would in a shop, to establish their nature, characteristics and functioning. You are only liable for any reduction in the value of the products resulting from handling that goes beyond that. This means you may open the packaging, but using a product beyond what is needed to assess it will reduce your refund. Where we apply such a reduction we tell you the amount and the reason, and the reduction is never more than the price you paid for that product.
8.8 If you withdraw, we refund all payments we received from you for the products returned. Where you return your entire order, we also refund the standard delivery cost you paid for that order. If you chose a delivery method more expensive than our standard option, we refund the standard cost only. Where you return part of an order and keep the rest, the delivery cost is not refunded.
8.9 We refund once your return has reached us and we have checked its condition, or once you have supplied evidence that you have sent the products back, whichever happens first. In any event we refund within 14 days of the day we are informed of your decision to withdraw.
8.10 We refund using the same payment method you used, unless you have expressly agreed otherwise. The refund costs you nothing.

9. Returns beyond the withdrawal period

9.1 In addition to your legal right in article 8, we offer a return period of 30 days from delivery.
9.2 The first 14 days are your statutory right and are governed by article 8. Days 15 to 30 are a commercial arrangement offered by us, and the following conditions apply to those days: the product must be unused and in its original packaging, and the return cost is yours. This commercial period does not affect your statutory rights in any way.
9.3 Returns in this commercial period are handled through our return portal, which you reach with your postcode and your order number. You do not need an account.

10. legal guarantee of conformity

10.1 We are legally required to deliver products that conform to the contract. You have a legal guarantee of two years from delivery. This guarantee means the product must have been free of defects and must have had the qualities you could reasonably expect at the moment it was delivered to you. It is not a guarantee that a product will last two years in use.
10.2 If a product does not conform, you are entitled to have it repaired or replaced free of charge, and we bear all the costs of doing so, including the cost of returning the product to us. If repair or replacement is impossible, disproportionate, not done within a reasonable time, or causes you significant inconvenience, you are entitled to a proportionate price reduction or to cancel the contract.
10.3 For the first year after delivery, a lack of conformity that appears is presumed to have existed at the time of delivery, unless we prove otherwise.
10.4 This guarantee does not cover normal use or consumption of a product, defects caused by misuse, failure to follow the instructions, normal wear, accidental damage, or repairs or modifications carried out by anyone other than us.
10.5 Cosmetic products carry either a date of minimum durability or a period-after-opening symbol on the packaging. This guarantee does not extend beyond that period.
10.6 To make a claim, contact us at hello@miure.com with your order number and a description of the problem. Please contact us within two months of noticing the defect, so that we can help you quickly.
10.7 Nothing in these terms limits your legal rights as a consumer.

11. codes, promotions and rewards

11.1 Codes are valid only for the period, the products and the conditions stated when the code is issued.
11.2 The welcome code for newsletter subscribers gives 10% off your first order. It is valid for 14 days from the moment it is issued, can be used once, and is for personal use. It applies to the full range, including sets and the lamp, and it can be used on products already sold at a reduced price.
11.3 Only one basket or order code can be used per order. This means the welcome code cannot be combined with another percentage or value code, with a birthday reward, with an anniversary reward, or with a referral reward. It can be used together with product level reductions, such as the price of a set.
11.4 Free delivery on orders of €65 or more is a standing shipping policy and not a code. It applies regardless of any code you use.
11.5 Codes have no cash value and cannot be exchanged for money.
11.6 If you return products bought with a code, we refund the amount you actually paid.
11.7 Our rewards program has its own conditions, available on the rewards page.
11.8 We may withdraw or change a promotion at any time for future orders. This does not affect orders already placed.

12. complaints and disputes

12.1 If something is wrong, contact us at hello@miure.com. We aim to reply within 3 working days.
12.2 If we cannot resolve it together, you can contact the Consumer Mediation Service, Boulevard du Roi Albert II 8 bus 1, 1000 Brussels, Belgium, contact@consumerombudsman.be, consumerombudsman.be.
12.3 You can also file a complaint with the Economic Inspection at the Belgian FPS Economy.

13. our liability

13.1 We are liable for the correct performance of the contract in accordance with the law.
13.2 We are not liable for damage caused by use of the products that does not follow the instructions and warnings supplied, or by modification of the products.
13.3 Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for defective products under product liability law, or for anything else that cannot be excluded or limited by law.
13.4 We are not liable for failure to perform caused by circumstances beyond our reasonable control, including natural disasters, war, strikes, carrier failures and government measures. If such a situation lasts longer than 30 days, either of us may cancel the contract, and we will refund any amounts you have paid for products not delivered.

14. personal data

14.1 We process your personal data in accordance with our privacy policy, available at miure.com/privacy.
14.2 Our privacy policy explains what we collect, why, how long we keep it, who we share it with, and how to exercise your rights.

15. intellectual property

15.1 The intellectual property rights in the miure brand, including the miure name and word mark, the logo, the packaging and product designs, the website, photography, text and other content, belong to Amazing Brands NV. Professionails NV uses them under licence.
15.2 The miure word mark is a registered trade mark. The design of the miure cap is a registered Community design at the EUIPO, and a corresponding registration is pending in the United States.
15.3 You may not copy, reproduce, distribute or commercially exploit any of this without prior written permission.
15.4 Buying a product does not transfer any intellectual property rights to you.

16. applicable law and competent court

16.1 Belgian law applies to these terms and to every contract concluded under them. If you live in another country of the European Union, you also keep the protection of the mandatory consumer rules of your own country.
16.2 As a consumer, you may bring a claim before the courts of the country where you live, or before the courts of our registered office. We may only bring a claim against you before the courts of the country where you live.

17. other provisions

17.1 If any provision of these terms is found to be invalid or unenforceable, the rest remains in force, and the invalid provision is replaced by a valid provision that comes as close as possible to its purpose.
17.2 The fact that we do not enforce a provision on one occasion does not mean we give up the right to enforce it later.
17.3 These terms are available in English, Dutch, French, German, Italian, Spanish and Portuguese. Further languages may be added. The English version is the authoritative version. In the event of a discrepancy between versions, the English version prevails, without prejudice to your right to rely on the version in the language in which the contract was concluded with you.
